Criminal Law News Update for November 19, 2007

State of New Jersey v. Harris (unpublished opinion of November 19, 2007): The court reversed the trial court decision and held that the National Crime Information Center (NCIC) Records should not have been admitted under the Business Records Exception to the Hearsay doctrine (N.J.R.E. 803(c)(6)) because the witness testimony failed to lay a proper foundation for the Business Records Exception to apply.

State of New Jersey v. Brent (unpublished opinion of November 19, 2007): The court affirmed the convictions for armed robbery holding that the trial court (1) must decide if the identification was impermissibly suggestive and (2) whether this identification procedure resulted in a "substantial likelihood of irreperable misidentification".

State of New Jersey v. Lige (unpublished opinion of November 19, 2007): The court held that the trial court correctly admitted the cocaine evidence because the officer had a reasonable, articulable suspicion that defendant was involved in criminal activity, authorizing an investigatory stop.
