New Jersey Law Governing Prescription Theft

A theft by deception committed for the purpose of fraudulently filling a pad, blank or form, is actually multi-layered. An individual faced with an arrest under this scenario is typically charged with not only a theft under N.J.S.A. 2C:20-3 but also prescription forgery and prescription fraud under N.J.S.A. 2C:21-1 and N.J.S.A. 2C:35-13 respectively. These charges, in addition to the theft, are usually filed as third-degree crimes. A third-degree offense involves potential fines exceeding $100,000, other assessments and up to 5 years in jail. A conviction can also give rise to a drivers license suspension and always results in a criminal record.
