Belmar DWI Arrest or Charge

An individual is subject to the penalties set forth under New Jersey’s DWI Law, N.J.S.A. 39:4-50, if he or she drives a motor vehicle while intoxicated in Belmar. The penalties for a summons for a first offense of DWI include a mandatory loss of license of between 3 months and 12 months, depending on an individual’s blood alcohol level at the time of the arrest. The penalties for a ticket for a second and third offense of DWI include license suspensions of 2 years and 10 years, respectively. There is also mandatory jail time of six (6) months if you are convicted a third offense of DWI in Belmar. Our attorneys have considerable experience defending DWI charges and we encourage you to contact our office and/or to consult our DWI site for additional information if you were issued a Belmar DWI ticket. We would stress that many individuals draw the conclusion that there is nothing an attorney can accomplish in a DWI case but this clearly is misinformation in our view.

Belmar Driving While Suspended Charges

Driving while suspended tickets issued under N.J.S.A. 39:3-40 are becoming more frequent in Belmar with the proliferation of on-board computers in almost every police car in the municipality. It is as easy as typing in a license plate number when someone is stopped at a light in order to determine whether they are driving while suspended. In the overwhelming percentage of cases, however, the defense lawyers at our office are successful in obtaining dismissal of a driving while suspended summons. There are notice requirements which must be established by the prosecutor in Belmar and because of this, the prosecutor is often amenable to amending this charge for a lawyer.

Belmar Driving Without Insurance Charges

Driving without Insurance under 39:6B-2 is a very serious offense and involves one year loss of license for a first offense and jail for a second or subsequent offense. It is always advisable for a defense lawyer to be handling this offense. Our defense lawyers make sure that every avenue of defense is exhausted and we also successful in the majority of cases in having this offense in Belmar amended to a lesser offense.

Belmar Leaving the Scene of an Accident Charges

If an accident involves anything more than minor damage, a conviction for leaving the scene of the associated accident under N.J.S.A. 39:4-130 generally carries license suspension of at least six (6) months. However, there is a lesser offense of failure to report an accident under N.J.S.A. 39:4-129 and our attorneys often succeed in having this amendment made such that no license suspension is imposed.

Belmar Possession of Drugs in a Motor Vehicle

This offense, N.J.S.A. 39:4-49.1, involves the greatest suspension period for a first offense at 2 years loss of license. It is obviously in your best interest to hire a lawyer if you have been charged with possession of drugs in a motor vehicle in Belmar.

Belmar Reckless Driving Summons

Reckless driving involves significant motor vehicle points upon conviction and can also involve license suspension. If you have been charged with reckless driving in Belmar, it is wise in our judgment for you to consult a lawyer as this violation can often be defeated and/or amended to lesser or no point violation.
