The officer can arrest or charge the person by issuing a ticket or summons under the local Seaside Heights Municipal Ordinance. This Ordinance couches a violation in terms of public nuisance or disturbance. A violation of the ordinance carries up to $1,250 in fines and up to ninety (90) days in jail. The second option for the police officer is to charge an assault under N.J.S.A. 2C:12-1 of New Jersey's Criminal Code. That statute prohibits any intentional physical contact that is offensive. If a simple assault is committed under the statute, a conviction carries up to six (6) months in jail in most cases.
