2nd Degree Aggravated Assault, 3rd Degree Terroristic Threats, and Simple Assault Remanded and Dismissed

Attorney Ryan Farrell Secures Dismissal of Aggravated Assault, Terroristic Threats, and Simple Assault Charges

Attorney Ryan FarrellThe Law Offices of Jonathan F. Marshall is pleased to announce a significant case result achieved by attorney Ryan Farrell in a matter that began in Atlantic County Superior Court and was later remanded to Hammonton Joint Municipal Court. The client was originally facing a serious second-degree aggravated assault allegation involving strangulation, along with related charges for terroristic threats and simple assault.

Through the efforts of the defense team, including attorney Louis A. Pintaro, the case was downgraded and remanded from Superior Court to municipal court. Mr. Farrell then appeared in Hammonton Joint Municipal Court and handled the municipal court proceedings.

Second-Degree Aggravated Assault Charge Remanded and Dismissed

The client was initially charged in Atlantic County with a second-degree offense arising from allegations involving a domestic dispute between spouses. A second-degree aggravated assault conviction in New Jersey can expose a defendant to significant prison time, a permanent criminal record, domestic violence-related collateral consequences, and serious damage to employment, reputation, and family stability.

After the matter was downgraded and remanded to Hammonton Joint Municipal Court, Mr. Farrell prepared the case for resolution by speaking with the client and the alleged victim, reviewing the circumstances surrounding the incident, and developing a strategy for how the matter should be presented to the municipal prosecutor.

Mr. Farrell also spoke directly with the prosecutor regarding the alleged victim’s position and the counseling the parties had undertaken since the incident. After reviewing the circumstances, the prosecutor elected to dismiss all remaining charges.

As a result, the client avoided a criminal conviction, and an expedited expungement of the client’s record was ordered.

Client Reinstated to Employment After Dismissal

The result was especially important because the client’s employment was also at risk. The client had been suspended without pay while the case was pending and faced an immediate deadline to resolve the matter or risk termination.

Following the dismissal of all charges, the client was reinstated to his job the next day.

Experienced Defense for Domestic Violence and Assault Charges in New Jersey

This result demonstrates the importance of experienced legal representation in domestic violence-related criminal cases, aggravated assault matters, and municipal court proceedings. A case that begins as a serious second-degree criminal charge in Superior Court may still present opportunities for downgrade, remand, negotiation, dismissal, or other favorable resolution depending on the facts, the evidence, the alleged victim’s position, the client’s background, and the work performed by the defense.
