Domestic Violence in Hunterdon County New Jersey

The New Jersey Prevention of Domestic Violence Act is set forth at N.J.S.A. 2C:25-17 and provides an array of protections to individuals, including the ability to seek a restraining order. Eligibility for relief is limited to victims who are: (1) the spouse or former spouse of the defendant; (2) present or former boyfriend or girlfriend of the defendant; (3) dated the victim; (4) resided with the defendant; or (5) share a child in common with the defendant. If the victim has standing because of one of these 5 relationships, they can seek a temporary restraining order in the event that they are assaulted, harassed, terrorized or otherwise subjected to domestic violence by the accused. Typically, a temporary restraining order will be issued immediately following a domestic violence police call in Flemington, Clinton, Raritan Township, Readington or elsewhere in Hunterdon County. If the police conclude, based on the allegations of the victim and the evidence at the scene, that there is probable cause to believe that “domestic violence” has occurred, they will call a judge to ask that a temporary restraining order be issued. Domestic violence is defined as one of the following acts committed against a qualifying victim:

  1. Simple Assault or Aggravated Assault
  2. Terroristic Threats
  3. Kidnapping
  4. Criminal Restraint
  5. False Imprisonment
  6. Sexual Assault
  7. Criminal Sexual Contact
  8. Lewdness
  9. Criminal Mischief
  10. Burglary
  11. Criminal Trespass
  12. Harassment
  13. Stalking
  14. Criminal coercion
  15. Robbery
  16. Contempt of a domestic violence order pursuant to subsection b. of N.J.S.2C:29-9 that constitutes a crime or disorderly persons offense
  17. Any other crime involving risk of death or serious bodily injury to a person protected under the “Prevention of Domestic Violence Act of 1991”
  18. Cyber-harassment

In addition to issuance of a temporary restraining order, the police may arrest the accused and file a separate criminal charge in the event that they find probable cause to believe that the law has been violated. An individual faces two parallel proceedings when this occurs, a restraining order hearing at the Family Division of the Hunterdon County Superior Court located in Flemington New Jersey and an independent criminal proceeding at either the county courthouse (if the charge is a first degree, second degree, third degree or fourth degree crime) or a local municipal court like the one in Tewksbury, East Amwell, Union Township, Lambertville or Bethlehem.
