What is a New Jersey Municipal Court?

Many people in New Jersey find that their first and only contact with the N.J. judicial system is in a local Municipal Court. They may be the defendant, a crime victim or a witness.

Four general categories of offenses are heard in Municipal Court:

  • Motor vehicle and traffic law violations
  • Municipal ordinance violations
  • Disorderly and petty disorderly persons offenses 
  • Violations of regulations of the N.J. Division of Fish and Wildlife, Division of Parks and Forestry, Office of Weights and Measures, and boating and animal cruelty regulations.

More serious crimes, such as robbery and assault, are known as indictable offenses. They may be initially filed in Municipal Court before being transferred to Superior Court. The county prosecutor may return such a case to the Municipal Court as a less serious charge but will usually present it to a Grand Jury to obtain an indictment. An indictment will be heard in a New Jersey Superior Court.

In criminal matters, such as an assault, shoplifting, harassment or drug possession, you will be required to appear in court. However, you can pay a fine without going to court if the “Court Appearance Required” box has not been checked on the complaint or if the charge is listed on either the Statewide Violations Bureau Schedule or the Local Violations Bureau Schedule.

Mediation and Appealing a N.J. Municipal Court Decision

If you face a charge that involves harm to another person, you may be required to work with a mediator to settle the dispute outside of court. You may also ask the court to allow mediation if your case is eligible.

You may appeal a verdict handed down in Municipal Court to the Morris County Superior Court. The Superior Court reviews the judge’s decisions and transcripts of Municipal Court trials on appeal and will only reverse a decision if it finds a mistake regarding the facts or application of the law.

You must file an appeal within 20 days of the Municipal Court decision. You can request that the Municipal Court penalty be “stayed,” or set aside, pending the outcome of your appeal. The judge will decide.
