"I had been charged with DUI for allegedly driving under the influence of drugs. The police officer was insistent that I was impaired and was very inflexible to doing anything short of a conviction. Jonathan and Colin fought anyway possible to help me."

We’ll See You Thru New Jersey’s Criminal Courts

When residents of Newark, Montclair, West Orange, South Orange and Maplewood turn to our law firm for help, they often have no prior dealings with the N.J. courts. They are understandably anxious and confused to have their futures in the hands of a justice system they do not understand.

However, our attorneys thoroughly understand the New Jersey criminal courts system. We know justice can be done for the accused in Newark and elsewhere in N.J. when they benefit from a legal defense that is focused on seeking the best results for them. Prosecutors are legally obligated to seek convictions, but they must prove guilt to win a case. Your defense team from the Law Offices of Jonathan F. Marshall brings 100 years of combined experience with New Jersey criminal law to your case. Our attorneys are ready to challenge every move the prosecution makes.

When the facts do not support the prosecution’s case, our attorneys can spot the weaknesses in the case as well as they can. We know the situations in which New Jersey law allows downgraded charges or lighter sentences. We have the professional relationships necessary to persuade a prosecutor to give fair consideration to cases when first-time offenders or individuals need drug rehabilitation or medical help instead of punishment.

Our attorneys’ depth of experience in Newark and throughout New Jersey ensures that Essex County prosecutors will consider our proposals when we suggest alternative charges or sentences. In many cases, it is the pre-trial work of a skilled defense attorney that results in a positive outcome for the defendant. We have the skill and knowledge of the New Jersey justice system to provide effective legal representation for you.

When a Newark defense lawyer from the Law Offices of Jonathan F. Marshall is your attorney, you’ll benefit from our experience, skill and dedication to obtaining the most favorable outcome available for you. For example, New Jersey offers several diversionary programs, including Pre-Trial Intervention (PTI), Drug Court and Conditional Discharge. One of these programs may be available to you as part of a plea bargain, but they have pros and cons that you would need to understand. Your attorney will make sure you are fully informed of the status of your case, your options and the long-term considerations that must be factored into decisions about how to defend you against criminal charges.

We Are Defense Attorneys for Newark, NJ

Newark is New Jersey’s largest city by population. Newark is also a business center in the New York City metro area, so many commuters come into and head out of the city and surrounding boroughs and townships in Essex County every day. With more than 277,000 people in Newark alone, conflict is inevitable and will in many instances rise to conflict with the law, both minor and in the extreme.

Minor criminal charges in New Jersey are categorized as “disorderly persons offenses” or “petty disorderly persons offenses” and are heard in municipal courts located where the charges were filed. More serious “indictable offenses” are heard in the local county Superior Court. Charges under federal law go to the United States District Court for the District of New Jersey, which tries cases in Newark, Trenton and Camden.

Anytime you have been charged with a criminal offense, you should engage a defense attorney to represent you. Your attorney is the only officer of the court required to look out for your rights and best interests. Prosecutors have professional obligations to obtain guilty verdicts and stiff penalties. A skilled defense attorney can ensure that your case is handled fairly and results in the best possible outcome for you.

Newark Municipal Courts & Essex County Superior Court

New Jersey’s municipal courts are known as courts of limited jurisdiction and process motor vehicle and parking tickets, municipal ordinance violations, and other minor criminal offenses. Serious criminal charges, such as assault, robbery or auto theft, may initially be filed in Newark Municipal Court or another municipal court, but will be transferred to Essex County Superior Court.
