Charged With Lewdness in Voorhees New Jersey

The offense of lewdness is set forth at N.J.S.A. 2C:14-4 of the New Jersey Criminal Code and is directed at individuals who engage in sexual gratification in public, typically through exposure or masturbation, upon an unwilling observer. The law defines “lewd act” as exposing of the genitals for the purpose of arousing or gratifying the sexual desire of the actor or of any other person. In order to convict someone of lewdness in Voorhees or another jurisdiction, the prosecutor must prove that: (1) the defendant performed a flagrantly lewd and offensive act; (2) that was observed by someone unwillingly; and (3) the defendant knew or reasonably expected would be observed by someone who would be offended, affronted or alarmed.

A violation of 2C:14-4 is typically a disorderly persons offense. However, when this conduct involves exposure of intimate parts for purposes of arousal or gratification involving an unwitting victim who the actor knows or reasonably should know is under thirteen years of age, the violation is a fourth-degree crime. “Intimate parts” means sexual organs, genital area, anal area, inner thigh, groin, buttock or breast of a person.
