Attorney James Fagen

Attorney James ‘Jim’ Fagen has been a practicing criminal attorney for over 45 years. He has tried every type of criminal case including murders, sexual offenses, arsons, drugs, thefts, burglaries, vehicular homicides, kidnappings, and robberies. He has also handled a number of white-collar cases.

Attorney Fagen has argued cases in the New Jersey Supreme Court as well as the New Jersey Appellate Division.

In the past, he served as an Assistant Prosecutor for the Monmouth County Prosecutor’s Office as well as a Municipal Prosecutor. As an Assistant County Prosecutor, Attorney Fagen was appointed to the position of Director of the Trial Division. During his tenure there, he successfully prosecuted the Staten-Island “Thrill Killer” Richard Biegenwald, a serial murderer. In addition to convicting a high-profiled serial killer, Attorney Fagen tried a number of murder cases including death penalty cases. In fact, he was one of the first attorneys in New Jersey to try a death penalty case.

As a defense attorney, Attorney Fagen has successfully defended individuals charged with serious criminal offenses and numerous persons charged with motor vehicle offenses, and related criminal charges in numerous Municipal Courts throughout the state. Many of the offenses involved “Driving Under the Influence”, one of which was his successful defense of a Chief of Police charged with DWI. Moreover, he was also sought out in another high-profile case wherein he was retained to defend a Staten-Island man that was accused of murder. Lastly, he recently garnered a hung jury on a high-profile theft charge that involved stolen Civil War gold certificates that were worth up to $3.5 Million dollars.
