Gun Charges in Burlington County New Jersey

There are many forms of gun offense that someone can face in Burlington County. Virtually every variety is a felony that can only be dealt with at the Superior Court. This is the only place where a crime of the fourth degree, third degree, second degree or first degree can be heard. Whether you were arrested in Burlington Township, Bordentown, Pemberton, Mt. Unlawful Possession of a Handgun. The firearm that is of most interest to police throughout Burlington County is unquestionably handguns. Unless a pistol or revolver is being transported to or from a gun range or gun shop, it cannot be possessed without a carry permit. This gun offense is a second degree crime that carries 5-10 years in prison and falls within the mandatory minimum term requirements of the Graves Act. Possession of a Sawed-Off Shotgun, Assault Rifle, Machine Gun or Defaced Firearm. Certain weapons are illegal to possess under any circumstance. Firearms such as sawed-off shotguns, machine guns, assault rifles and defaced firearms are weapons that are strictly prohibited in New Jersey. Possession of a machine gun or assault rifle is a second degree crime. It is a third degree crime to possess a sawed-off shotgun and a fourth degree crime to possess a defaced firearm.

Illegal Transport of Guns & Firearms. N.J.S.A. 2C:39-6g requires that firearms be transported: (1) unloaded; (2) in a case, box or another secured device, or locked in the trunk; and (3) that travel with the weapon be limited insofar as reasonably necessary.

Possession of a Handgun, Rifle, Shotgun or Other Gun for an Unlawful Purpose. An additional gun charge that can arise in Burlington County is possession for an unlawful purpose. This offense arises where an individual possesses a firearm such as a handgun in order to use it unlawfully against another person or property. Certain Person Not To Possess a Gun. When someone is convicted of burglary, robbery, distribution of CDS, aggravated assault and many other felonies, they become a “certain person” that is prohibited from possessing any type of firearm. When a Burlington County certain person offense is predicated on a prior felony record, the offense is a second degree crime. It is a third degree crime where the charge is based on a  domestic violence conviction and a fourth degree crime where it is the result of a prior psychiatric/mental health finding.

Graves Act Implications. Another consideration for anyone charged with a gun violation in Burlington County is the Graves Act. Strict sentencing requirements, specifically, a mandatory minimum term of imprisonment must be imposed at the time of sentencing at the county courthouse in Mount Holly.
