Aggravated Assault Lawyers in Bayonne, New Jersey
Aggravated Assault can be either a second, third or fourth degree felony in New Jersey. What degree of aggravated assault one will be charged with will depend on two key elements: what is the injury suffered and who was the victim. For example, if a Defendant has committed what otherwise would have been a simple assault (due to the conduct in question & alleged injury) but the victim was either a police officer or school official the charges will automatically be increased to aggravated assault, most likely in the third degree. Juveniles Charged with Aggravated Assault in Bayonne, NJ
Two females who attend Bayonne High School have been charged with amongst other things, aggravated assault on a police officer, resisting arrest and simple assault. According to the reports, two juveniles, one sixteen years old and the other seventeen were involved in a physically altercation with each other. The incident occurred on the Bayonne High School property and when a security guard attempted to intervene to breakup the fight, he was struck several times by the juveniles. Then to make matters worse, when the Bayonne police responded, one of the juveniles resisted arrest and in doing so struck the officer several times. The seventeen year old has been formally charged with aggravated assault on a police officer, resisting arrest and most likely simple assault for the initial fight. The sixteen year old has formally been charged with aggravated assault on a school employee and most likely simple assault as a result of the initial fight as well. Since both parties are juveniles their cases will be heard in the Hudson County Family Division rather than the Hudson County Criminal Division. Although, with that being said, the Hudson County Prosecutor’s office could waive both parties up and prosecute them as adults.
