Penalties for a First Offense in New Jersey

The penalties that apply if you are convicted of your first offense hinge on the blood alcohol content (“BAC”) that is introduced at the time of your plea or finding of guilt. It the submitted BAC is .08-.099% you will face a three month license suspension and fine of $200-$400. When the BAC submitted into evidence is .10% or higher, the suspension period escalates to seven to twelve months along with the fine to $300-$500. Irrespective of whether the conviction involves a first tier or second tier BAC reading, there are additional penalties that apply. All first offenders must spend 12-48 hours in the Intoxicated Drivers Resource Center and pay an annual surcharge of $1,000 for three years. There is also mandatory installation of an ignition interlock device for 6-12 months if the BAC is .15% or higher, otherwise, whether to impose this penalty for a first offense is left to the discretion of the sentencing judge.
