DWI School Zones or Crossings

It is important to note that if you are accused of drunk driving or breathalyzer refusal in a school zone or crossing, the penalties are enhanced. An individual who is convicted of refusing a breath test in a school zone is sentenced to one to two years driver’s license suspension, a $600 to $1,000 fine and a minimum of 12 hours in an intoxicated driver’s resource center. If someone is convicted of a DUI/DWI in a school zone or crossing, he or she may be sentenced to 12-14 months driver’s license suspension, a $500 to $800 fine and up to 60 days in jail. All of these sentencing guidelines for both the refusal and the DUI/DWI are for first offenses. Subsequent offenses are subject to even harsher penalties.
