DWI Jail Time in New Jersey

A DWI conviction can have a serious impact on your life even if you have never been charged with a traffic offense before. In addition to fines and license suspensions, you may face the prospect of jail time. At the Law Offices of Jonathan F. Marshall, you will find lawyers who know the New Jersey DUI penalties and how to defend you against them.

Protecting You Against NJ DWI Jail Sentences

Whether you are sentenced to jail, and the time you receive, will depend on whether you have previous DWI convictions and on the circumstances of your case.

  • First-offense DWI: If the charge is your first, the maximum sentence is 30 days in jail. You may not be sentenced to any jail, however.
  • Second-offense DWI: You may be required to serve a minimum of 48 hours in custody. The maximum sentence for a second offense is 90 days in jail.
  • Third-offense DWI: For a third or subsequent offense, you will be required to serve at least 90 days in jail. The court can sentence you to up to 180 days in jail, but may reduce some of that time for your participating in an inpatient rehabilitation program.

When we represent you, we will work to reduce or eliminate the amount of jail time you are required to serve if you are convicted of DWI.
