Burlington County Cocaine Distribution Charge
A charge for distribution of cocaine is always a felony crime of the first, second or third degree so it can only be dealt with at the Burlington County Superior Court in Mount Holly New Jersey. A first degree charge for selling, distributing or possessing cocaine with intent to distribute results under N.J.S.A. 2C:35-5 if the quantity involved is 5 ounces or more. Distribution of at least one-half ounce but less than 5 ounces of cocaine is a second degree crime under this law. The least severe form of possession with intent or distribution is a third degree crime and applies when the weight is less than one-half ounce.
A first degree cocaine distribution offense results in 10-20 years in prison and a fine of up to $500,000. The period of imprisonment is 5-10 years and the fine is up to $150,000 for second degree possession with intent to distribute cocaine. A third degree distribution of cocaine conviction can land you in prison for up to 5 years and result in a fine that can reach $75,000. Please note that separate drug charges and additional penalties apply if your activities involve distribution in a school zone, distribution in a public park, maintaining a cds production facility or being a leader of a drug trafficking network. The same holds true possession of a firearm during cds activities.
